NAIS Assessment of Inclusivity and Multiculturalism (AIM) Terms and Conditions

NAIS does not warrant or guarantee the outcome of the use of this tool. All schools should use the Assessment of Inclusivity and Multiculturalism (AIM) as an assessment tool only and take such action as necessary and appropriate for that school's community. Each school will likely have different responsive actions to the assessment and NAIS bears no liability for the decisions of the school's leadership in response to the AIM resultant data. AIM is the intellectual property of NAIS. By registering for and using AIM, the participant school acknowledges that NAIS will have access to and own all resultant school data. The participant school has a limited license to use its data as outlined below.

Refund Policy: When requested in writing, NAIS will refund the cost of the assessment as follows: If no training has taken place, a total refund minus $300 intellectual property, administrative processing fee is available if done within a year of purchase.

Intellectual Property: AIM, including but not limited to, the name, logo, survey instrument including additional questions added by individual schools, user manual, school self-assessment guide, guide to understanding and evaluating your AIM results, reports, individual school data, and benchmarking data, is the intellectual property of NAIS. Schools may not externally share or post the survey instrument (in whole or in part) or the user manuals and guides provided to assist in the implementation or evaluation of survey results (including but not limited to the user manual, school self-assessment guide, guide to understanding and evaluating your AIM result),

AIM is meant to assist authorized purchasers in surveying members of the school community, analyzing survey data, and benchmarking findings against aggregate school data when possible. It is not intended to be available for personal use or as part of any effort to cause harm to individual schools, the NAIS membership, or independent education. Participant school is provided a limited license to use their individual school data and benchmarking data for internal purposes.

Logo: The user authorizes NAIS to use the provided school logo in conjunction with AIM and provided through the NAIS Survey Center tool. This limited license allows NAIS to attach this logo to the survey sent to the various individual contacts whose information is being provided to the Association, as well as in other reports provided through the NAIS Independent School Survey Center. The user is authorized by the School to provide such permission to the Association, and understands the way(s) in which the logo will be used.

Minors' Use of AIM:  Some surveys within the Independent School Survey Center including AIM may be appropriate for use with students, including students under the age of 13. Schools that use AIM with younger students hereby warrant and guarantee that they have either obtained appropriate participation permission from parents or guardians or are authorized to provide such permission for students to participate in the surveys. NAIS shall not be liable for determining the age of participants or securing any required parent or guardian permission.

Identifiable Information: We do not collect personally identifiable information in the course of this survey. We may have information that could aid a school in determining the computer used to submit responses. This information will only be provided if there is reasonable concern for student or community safety and well-being.

Acknowledgment, Acceptance, and Release of Liability: By using the AIM Survey and the NAIS Independent School Survey Center, the user signifies that they accept these terms and conditions on behalf of the school and the school hereby releases NAIS of any liability resulting from improper or proper use of this information by the school, its agents, or any other individual or entity.
NAIS does not warrant or guarantee the accuracy of any of the information found in or created by the AIM Survey, nor does it warrant or guarantee that the resultant information or reports created by the AIM Survey is appropriate for any particular purpose.

NAIS is NOT responsible for any consequences or damages resulting from errors or inaccuracies in the data or the use or operation of this site by the school or others. This is true at all times, including during beta testing of the NAIS Independent School Survey Center or AIM Survey. Organizations using the AIM Survey acknowledge that their survey results data may and will be included anonymously in the cumulative data NAIS will collect, store, and disseminate for benchmarking, research, and general publication purposes.

In no event shall NAIS or any third parties mentioned on the NAIS website be liable for any damages whatsoever, including without limitation incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use or inability to use the NAIS Independent School Survey Center, the AIM Survey, and the material therein, whether based on warranty, contract, tort, or any other legal theory, and whether or not NAIS is advised of the possibility of such damages.

Entire Agreement: This Agreement states the entire agreement between the parties and supersedes any prior agreements, understandings, or representations with respect thereto. Any addition or modification to this Agreement must be made in writing and signed by authorized representatives of both parties. This Agreement is made under and shall be construed according to the laws of the District of Columbia, U.S.A. In the event that this agreement is breached, any and all disputes must be settled in a court of competent jurisdiction in the District of Columbia, U.S.A.
